This Refunds Policy outlines the terms under which refunds may or may not be issued for Services provided by HowdyPixel. By engaging our Services and making payment, you agree to this policy. This policy should be read alongside our Terms & Conditions.
A deposit of 50% of the total agreed project cost is required before work begins. This deposit is non-refundable in all circumstances, including but not limited to: (a) you changing your mind about the Project; (b) you deciding not to proceed after work has commenced; (c) delays caused by your failure to provide required materials or feedback; (d) circumstances unrelated to the quality of our work.
The deposit secures your place in our schedule and compensates for the time, resources, and opportunity cost of commencing your Project. Work begins immediately upon receipt of the deposit.
The remaining 50% balance is due upon completion of the Project, before the website is made live or Deliverables are transferred. Once the final payment has been made and the website or Deliverables have been delivered, no refund of the final payment will be issued. You are given the opportunity to review and request changes before final payment — this constitutes your acceptance of the work.
If you cancel a Project after the deposit has been paid:
(a) Before work commences: The deposit is non-refundable. No further charges apply.
(b) After work has commenced but before completion: The deposit is non-refundable. You may also be liable for additional charges reflecting the work completed to date, calculated at our standard hourly rate. If the work completed exceeds the deposit amount, the difference will be invoiced.
(c) After completion and final payment: No refund will be issued. The Deliverables are yours as per our Terms & Conditions.
If we cancel a Project for reasons within our control and unrelated to your actions or omissions, we will refund any payments made minus the fair value of work already completed. If we cancel due to your breach of our Terms, non-cooperation, or failure to provide required materials within a reasonable timeframe (typically 30 days of request), no refund will be issued.
Hosting and recurring services (including email management) are billed monthly in advance. Hosting payments are non-refundable for the current billing period. You may cancel hosting at any time with 30 days' written notice. Upon cancellation, service continues until the end of the paid period, after which the website will be taken offline. No partial-month refunds are issued.
Domain registration fees are non-refundable once the domain has been registered, as this is a third-party service processed immediately upon purchase. Domain renewal fees are similarly non-refundable.
Any fees paid to third-party services on your behalf (including Microsoft 365, Google Workspace, premium plugins, stock imagery, or other tools) are non-refundable through HowdyPixel. Refund requests for third-party services must be directed to the relevant provider.
If you believe the work delivered does not meet the agreed specification, you must notify us in writing within 7 days of delivery. We will review the concern in good faith and, where the work genuinely falls short of the agreed scope, will make corrections at no additional cost. This does not constitute grounds for a refund where the work substantially meets the agreed specification. Subjective dissatisfaction with design choices made within the agreed scope does not constitute a quality dispute.
If you initiate a chargeback or payment dispute through your bank or payment provider without first attempting to resolve the issue directly with us, we reserve the right to: (a) immediately suspend all Services, including taking your website offline; (b) pursue recovery of all outstanding amounts plus any fees incurred; (c) retain all Deliverables until the dispute is resolved in our favour.
In exceptional circumstances, refunds may be considered at the sole discretion of HowdyPixel. Any discretionary refund does not set a precedent and does not waive our rights under this policy or our Terms & Conditions.
Nothing in this policy affects your statutory rights under the Consumer Rights Act 2015 or any other applicable UK legislation. However, as our Services are bespoke and made to your specification, the right to cancel under the Consumer Contracts Regulations 2013 may not apply once work has begun with your express consent.
We may update this Refunds Policy at any time. Changes will be posted on this page with an updated date and apply to new Projects from that date forward.
